Dear Tom,

I am on the maillist for the Triathlon Club of San Diego. The
victim was a Tri Club member, and these messages were posted to the list
(which is public). As you'll see in the second message, apparently
there is some lack of definition as to whose responsibility the road in
question is. Hope this information will be useful to you, and if
you feel it's appropriate, I'm sure it's okay to forward to the SDCBC
list.

Thanks for all the nice thoughts and calls. Pat is not in the best
shape... he shattered his pelvis, broke his collar bone, and has
many cuts and bruises everywhere including his face and head.
Judging from the shape of his helmet the impact to his head was
severe. His leg is now in traction with surgery planned later this
week after a determination that there are no internal injuries. We
don't know too much about the accident as there were no witnesses and
he has no memory of the event. He was found unconscious. We think
it was an unmarked speed bump as you descend Artesian/Zumaque Rd.
(Sante Fe area)
He is really not up for visitors... but once again thanks for all of
your kindness.
Dear Elizabeth and Patrick

I am shattered to hear about this. I am sorry and saddened. I have been
contemplating painting the speed bump right next to the Lusardi State
Park, at the bottom of the hill on Artesian, going to Zumaque (the first
speed bump). In September of last year, I crashed descending down
Artesian descending about 35mph, the same location you have described. I
was found unconscious and ended up at Palomar Medical Center. I also
experienced several bruises, concussion, memory loss, vertigo, and more.
Luckily I did not break any bones.
Currently, I am in debate on claims against the County of San Diego for
negligence, not having marked the speed bump in any form whatsoever. At
first the county claimed that the street was private and maintained by
the Rancho Santa Fe Association. I wrote a letter to RSF Association only
to learn that their part of the property is 60-100yds in. I went back to
the County of SD. I am still trying to learn who maintains the street.
The county is claiming they only maintain a part of it, blah, blah,
blah...
So far no one has taken responsibility for maintaining the road.
If anyone in the club has any ideas on how to pursue this, Please let me
know.
Good luck with your recovery.

Caution and a word to the wise:

On my Sunday morning ride, I came upon the scene of a bike
accident

that was attributed (according to the Rancho Santa Fe Trooper at
the

scene) to the cyclist hitting a speed bump at a high rate of speed

and losing control. The identity and condition of the rider are
not

known to me but he/she was taken away from the scene by
ambulance.

The site of the accident was near the bottom of the grade on
south

bound Artesian Road (Thomas Bros. 1168 H4) before the locked gate

that blocks free access to switch back north on Zumaque Street and
up

a steep grade to Las Colinas.

This popular and scenic east/west route between Rancho
Bernardo/4S

Ranch and Rancho Santa Fe traverses private roads which bear warning

signs about limited access. The speed bumps in question are
rather

sharp and are not marked in any way. They are very hard to

see. High speeds are easy to achieve coming down the Artesian
Rd grade.

While the Trooper mentioned did not attempt to prevent my group from

traversing the private road (in fact he even used his remote to
open

the locked gate for us), he did warn us that we were on private
land

and that we should exercise caution as we were "on our own"
if we

happened to get into any kind of difficulty. In this case I
guess we

cannot complain to CalTrans about the lack of makings on the speed
bumps.

I'll ride there again but - to quote a police Sergeant from a popular

TV program - "be careful out there".
