Section 888 of the California Streets and Highways Code states, "The department [Caltrans] shall not construct a state highway as a freeway that will result in the severance or destruction of an existing major route for nonmotorized transportation traffic and light motorcycles, unless it provides a reasonable, safe, and convenient altnate route or such a route exists."
One might need to argue that this applies even though the Transportation Corridor Agency is not Caltrans, and that a toll road is not a freeway, but that's what the law says.
