I hope she's ok. From the sounds of your post, she was over riding her
headlight since she didn't have time to react. While I'm not a lawyer,
it sounds like there's some negligence on the "construction company" yet
there's also negligence on the riders behalf. Kind of like riding with
your eyes closed and not expecting to hit something. I personally tend
to like to see where I'm going, and if it's dark enough that I can't
stop in time for something in front of me, I slow down. It's not a
biketopia out there...
